If you disagree with these T&C or any part of these T&C, you must not use or interact with Car Rewards. All gift certificates or rewards are provided and collected solely after the purchase of your new vehicle at all participating dealerships or outlets.
Car Rewards does not provide any gift certificates, rewards, cash incentives or any prizes which are redeemable directly through Car Rewards. All rewards, cash incentives, gift certificates or prizes are solely redeemable from participating outlets such as motor dealerships or the like.
If any participating outlet or motor dealerships does not accept your reward, gift certificate or other incentive, please contact Car Rewards via email or telephone and we will respond accordingly to assist you with your enquiry to the outlet.
After reading all the Terms and Conditions, with Car Rewards, you fully agree and are bound by these Terms and Conditions:You may use Car Rewards if you are aged 18 years or over, have a current Australian residential address and are otherwise deemed by Car Rewards, in its absolute discretion, to be eligible to use Car Rewards. By using Car Rewards, and by agreeing to these T&C, you warrant and represent that you are at least 18 years of age.
Unless otherwise stated, Car Rewards is patented and owns the intellectual property rights to the website, the SMS functionality, and the material on the website. The website, products, technology and processes involved with Car Rewards may be the subject of other intellectual property rights owned by Car Rewards or by third parties. Your use of Car Rewards must not in any way infringe the intellectual property rights of any person. Subject to the license below, all these intellectual property rights are reserved.
Car Rewards includes registered trademarks, and other marks that are otherwise protected by law. You may not use these trademarks without Car Rewards's express consent.
You must not use Car Rewards in any way that causes, or may cause, damage to Car Rewards or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You must not use Car Rewards to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the website without Car Rewards’s express written consent.
You must not use Car Rewards to transmit or send unsolicited commercial communications. You must not use Car Rewards for any purposes related to marketing without Car Rewards’s express written consent.
By using Car Rewards software, each Car Rewards user agrees to the collection, use and disclosure of their personal information.
The types of personal information we collect include, but are not limited to: name, contact details, identification information, reward card or membership details, and reward and gift certificate details, authorisations, personal information of friends or family members, records of your communications and interactions with us and the Car Rewards program, and details/history of preferences, interests and behaviour relating to transactions, products, services, and activity with our digital services.
We may not be able to provide our services without your personal information. For example, we may not be able to answer enquiries, send you gift certificates, or contact you.
Car Rewards uses cookies. By using Car Rewards and agreeing to these terms and conditions, you consent to Car Rewards's use of cookies.
Collection when there may not be awareness: Car Rewards users may not be aware that we collect personal information about them when they use a device, such as a mobile phone or computer, to look at online content or to communicate. This allows us to collect personal information about Car Rewards users via cookies. We also combine different sets of data to add to the personal information we hold.
Collection under a law or order: Many Australian laws authorise or require the collection of personal information about Car Rewards. These include taxation laws, corporations law, antimoney laundering laws and privacy laws. We may also collect personal information about Car Rewards users where required or authorised by a court/tribunal order.
Collection purposes: We collect personal information to send certificates and answer enquiries; offer benefits and special deals under the Car Rewards Terms and Conditions; to learn of members’ preferences so that we may promote our services in a way which may be of most interest to some or all of our customers and to de-identify it for further analyses on preferences and shopping patterns and de-identified disclosures. We may also collect this information for other purposes which are within Car Rewards users’ reasonable expectations or permitted by law. Keeping our records of personal information correct and up-to-date and investigating Car Rewards users’ complaints and enquiries are examples of these other purposes.
The third parties to whom we disclose personal information may be located in Australia and other countries including Philippines. We take steps to ensure that all our service providers agree to protect the privacy and security of your personal information, and use it only for the purpose for which it is disclosed.
Consent to receive direct marketing and other marketing communications:By using Car Rewards you consent to receiving marketing and promotional communications and material from Car Rewards, participating dealerships and other program partners by email, text message or other digital service, phone or post, subject to obligations under applicable law. Subject to any applicable Law, you agree that Car Rewards does not need to include an "unsubscribe" facility in any electronic message sent to you.
Car Rewards will send reminder emails regarding gift certificates, enquires or other others via email or sms. Car Rewards may send additional offers or clearance sale offers from time to time via email or SMS. Car Rewards or participating dealerships or companies may contact you via phone, email or SMS.
Car Rewards may, at any time, apply or change any additional terms regarding the redemption of Points for particular types of rewards or gift certificates.
All rewards or redeemable gift certificates are subject to availability and restrictions imposed from time to time by the dealerships or outlets of the reward or gift certificate programs. Separate terms and conditions may govern the relationship with participating dealerships, or third parties and the supply of rewards or gift certificates.
Car Rewards will send rewards or gift certificates via email or sms.
Car Rewards will endeavour to deliver rewards or gift certificates within a very short time frame, but this may not always be possible. You must call Car Rewards as soon as possible if you do not receive your reward or reward email within the specified delivery time.
It is your responsibility to inform us if:
You or your 'friend’s' (in the event of certificate transference) personal details change (including, but not limited to, your address, email address or phone number). If we do not have your correct details, we may not be able to contact you about your enquiries or gift certificates or send you offers or rewards.
Any unused reward or gift certificate will expire after 28 days from the date of issue, unless renewed or transferred before that date.
If gift certificate email or gift certificate is lost, it will not be re-issued.
Rewards or gift certificates are not redeemable or exchangeable for cash or travellers cheques.
Any tampering or defacing or unauthorised use of a reward or gift certificate will render it invalid.
A gift certificate or a reward must be redeemed at a participating dealership.
A gift certificate or a reward can only be redeemed when purchasing a vehicle. The vehicle has to be currently advertised with Car Rewards and, in some cases, has to match the Car Rewards code used when requesting certificate.
Not all dealerships participate in the program. Participating dealerships will offer different benefits and will vary from time to time.
In the electronic cyber world, Web-sites offer cash incentives. Car Rewards does not trade, in cash, offers cash and will not give cash to anyone or entity.
Access to certain areas of Car Rewards is restricted. Car Rewards reserves the right to restrict access to areas of the website, or indeed this entire website, at Car Rewards’ discretion.
If Car Rewards provides you with a way to enable you to access restricted areas of the website or other content or services, you must ensure that it is kept confidential.
Car Rewards may refuse any of your applications for any reason. Car Rewards reserves the right to, at its discretion; block you from accessing its software.
Car Rewards may contain links to, or frame, websites of third parties ("external sites"). Car Rewards is not required to maintain or update the links.
Links to, or framing of, external sites should not be construed as any endorsement, approval, recommendation or preference by Car Rewards of the owners or operators of the external sites, or for any information, products or services referred to on the external sites unless expressly indicated on this website.
Car Rewards makes no warranties and accepts no liability in relation to material contained on external sites.
Car Rewards is provided “as is” without any representations or warranties, express or implied. Car Rewards makes no representations or warranties in relation to this website or the information and materials provided on this website.
Nothing on Car Rewards constitutes, or is meant to constitute, advice of any kind.
Neither Car Rewards, nor any program partner or participating dealership will be liable for any loss, damage or expense (however caused) arising from any failure or omission by program partners or participating dealership to supply particular rewards or gift certificates.
These limitations of liability apply even if Car Rewards has been expressly advised of the potential loss.
Nothing in this disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this disclaimer will exclude or limit Car Rewards’ liability in respect of any:
You accept that, as a limited liability entity, Car Rewards has an interest in limiting the personal liability of its officers, contractors, sub-contractors, and employees. You agree that you will not bring any claim personally against Car Rewards’s officers, contractors, sub-contractors, or employees in respect of any losses you suffer in connection with the website or dealerships or outlets.
Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this disclaimer will protect Car Rewards’s officers, employees, agents, subsidiaries, successors, assigns, contractors and sub-contractors as well as Car Rewards.
Car Rewards will not be responsible for any issues or errors caused by it or any third party (including third parties who may provide technology or other services to Car Rewards).
Car Rewards FaceChat Help Desk or any participating dealerships or companies are not permitted or authorised to make any representation, warranty or statement on behalf of Car Rewards. As such, Car Rewards accepts no liability in respect of any representation, warranty or statement made by any Car Rewards FaceChat Help Desk, participating dealership, or company or any Car Rewards employee, agent, contractor or sub-contractor.
Third parties who may be involved in the program do not have any authority, express or implied, to make any representation, warranty or statement on behalf of Car Rewards and Car Rewards accepts no liability in respect of such representations, warranties or statements.
Links to, enquiry forms for, and references of other companies or dealerships should not be construed as any endorsement, approval, recommendation or preference by Car Rewards of the owners or operators of these companies or dealerships, or for any information, products or services provided by these companies unless expressly indicated on this website.
Car Rewards makes no warranties and accepts no liability in relation to these companies or dealerships.
You are solely responsible for any government tax, duty or other charge imposed by law in any country in respect of the program, your participation in the program, any gift certificates or rewards redeemed or any other transaction within the program
You hereby indemnify Car Rewards and undertake to keep Car Rewards indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Car Rewards to a third party in settlement of a claim or dispute on the advice of Car Rewards’s legal advisers incurred or suffered by Car Rewards arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
Without prejudice to Car Rewards’ other rights under theseT&C, if you breach these T&C in any way, Car Rewards may take such action as Car Rewards deems appropriate to deal with the breach, including suspending your access to Car Rewards, prohibiting you from accessing Car Rewards, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
Car Rewards may transfer, sub-contract or otherwise deal with Car Rewards’ rights and/or obligations under these T&C without notifying you or obtaining your consent.
You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these T&C.
If a provision of these T&C is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
If any provision of this disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this disclaimer.
These T&C are governed by the law of Queensland, Australia. The parties submit to the nonexclusive jurisdiction of its courts and courts of appeal from them. The parties will not object to the exercise of jurisdiction by those courts on any basis.
These T&C constitute the entire agreement between you and Car Rewards in relation to your use of Car Rewards, and supersede all previous agreements in respect of your use of Car Rewards.
Car Rewards reserves the right to change these terms and conditions from time to time.
